Punishment for Drug Trafficking or Trafficking a Controlled Substance

Punishment for Drug Trafficking depends on the alleged substance trafficked and the amount of the controlled substance. The possible punishments associated with the controlled substances and the weight include:

-28 grams or more but less than 200 grams- mandatory minimum of 10 years in prison plus a fine of $200,000.00

-200 grams or more but less than 400 grams- mandatory minimum of 15 years in prison plus a fine of $300,000.00

-Over 400 grams- mandatory 25 years in prison and a fine of $1 million.

Trafficking Opium or Morphine:

-4 grams or more but less than 14 grams- mandatory minimum of 5 years in prison and a $50,000.00 fine

-14 grams or more but less than 28 grams- mandatory minimum of 10 years in prison plus a fine of $100,000.00

-28 grams or more- mandatory minimum of 25 years in prison plus a fine of $500,000.00

Trafficking Marijuana: 

-10 pounds but less than 2,000 pounds- mandatory minimum of 5 years in prison plus a fine of $100,000.00

-2,000 pounds or more but less than 10,000 pounds- mandatory minimum of 7 years in prison plus a fine of $250,000.00

-more than 10,000 pounds- mandatory minimum of 15 years in prison plus a fine of $1 million

Trafficking Methaqualone:

-200 grams or more but less than 400 grams- mandatory minimum of 5 years in prison plus a fine of $50,000.00

-400 grams or more- mandatory minimum of 15 years in prison plus a fine of $250,000.00

Trafficking Methamphetamine:

-28 grams or more but less than 200 grams- mandatory minimum of 10 years in prison plus a fine of $200,000.00

-200 grams or more but less than 400 grams- mandatory minimum of 15 years in prison plus a fine of $300,000.00

-Over 400 grams- mandatory 25 years in prison and a fine of $1 million.

Manufacturing Methamphetamine:

-less than 200 grams- mandatory minimum of 10 years in prison plus a fine of $200,000.00

-200 grams or more but less than 400 grams- mandatory minimum of 15 years in prison plus a fine of $300,000.00

-Over 400 grams- mandatory 25 years in prison and a fine of $1 million.

Trafficking in Ecstasy:

-28 grams or more but less than 200 grams- mandatory minimum of 3-30 years in prison plus a fine of $25,000.00-$250,000.00

-200 grams or more but less than 400 grams- mandatory minimum of 5-30 years in prison plus a fine of $50,000.00-$250,000.00

-Over 400 grams- mandatory 10-30 years in prison and a fine of $100,000.00-$250,000.00

Alternatives to the Mandatory Minimum Sentences for Drug Trafficking

The law does allow for certain people charged with Drug Trafficking to be eligible for sentences below the mandatory minimums if the person accused meets certain conditions. The Judge is authorized to sentence below the Mandatory prison time if:

  1. The accused was not a leader of the criminal conduct
  2. The accused did not possess a firearm or weapon
  3. The Conduct did not result in death or serious bodily injury to any persons other than those involved in the crim
  4. No prior felony convictions
  5. Interests of justice willn ot be served by the imposition of the prescribed mandatory minimum.
